La Cour de cassation ferme la porte : si l\u2019employeur ne prouve ni l\u2019\u00e9v\u00e9nement ni la date du terme, et laisse perdurer le lien contractuel, le CDD se mue en CDI. <\/p>\n\n\n\n<p>Ici, pendant plus de deux ans, aucun \u00e9crit de fin de contrat, aucun document remis, alors m\u00eame que le salari\u00e9 remplac\u00e9 avait cess\u00e9 son activit\u00e9. Le rempla\u00e7ant reste pay\u00e9 sous CDD\u2026 jusqu\u2019\u00e0 l\u2019accident du travail, puis l\u2019inaptitude, puis plus de salaire. Le salari\u00e9 prend acte : la Cour lui donne raison et y voit un licenciement injustifi\u00e9, faute de reprise des salaires apr\u00e8s l\u2019avis d\u2019inaptitude.<\/p>\n\n\n\n<p>Message clair : on ne joue pas avec le flou du terme impr\u00e9cis pour prolonger la pr\u00e9carit\u00e9.
